Terms & Conditions of use

This Terms of Use Agreement constitutes a legally binding agreement made between you ( Subscriber, Member or  user of DriveCarma app) whether personally or on behalf of any other entity and with FOREVER WITH U PRIVATE LTD (referred in the page as DriveCarma, Company, we, us or our)

• Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• Application refers to Drivecarma mobile app provided by the Company.
• Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Drive Carma.
• Country refers to:  India
• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Service refers to the Service offered by Drivecarma mobile app or the Website or both.
• Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
• Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit)
• Website refers to Drive Carma, accessible from www.drivecarma.com
• You means the individual accessing or using the Service , or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

ACCEPTANCE

By using or continuing to use our mobile app it would  deemed as your acceptance to the contents listed in this page.

LIMITATIONS OF USE AND USER HAS CONTROL

DriveCarma does not gurantee proactive safety, nor does it claim that it can stop vehicle accidents or hazards. Apps provides insights to given parameters made available time to time and offer its users with trip insights after completing a trip.DriveCarma entrusts its users to set a Speed limit goal for themselves while the users adhere to  applicable law or per local traffic authorities per road driving locations g) Highway, city limits , bridge etc. DriveCarma does not prescribe driving speed limits or nor an enforcing authority, or not rating agency to classify driving skills, while Drivecarma app is created with a positive intent to promote conscious driving on road and understand post trip events. Drivecarma does not encourge using mobile or cell phone while driving.  Once trip or Start drive mode is enable in the app, user is expected to focus on driving without distractions on cell phone  and not expected to keep checking the app details while driving.  Once the driving or trip is completed, user has the capability to end driving Tripmode on the app. If users feel that they wish to delete a trip, they can by selecting the option in the trip history log. 

IMPERSONATION 

While we ensure that only a vehice owner or authorised person leverages the app for benefical service offering.  If any user found to impersonate or hoodwink  by following deliberate attempt to misrepresent the app usage, access to app services would be cancelled with notification. 

SERVICE AVAILABILITY

While we ensure that our services are available to our users all the time, but for reasons beyond our control, there could be downtime, But we would ensure to do our best maintain our services up and running as soon as possible.

REFUND  POLICY

While we offer value for money paid to us, and strive for best client services, however  for reasons unknown, if  Paid user wants to seek refund, they can request for refund of their subscription or terminate their subscriptions  by a written notice within 30 days prior to end of contract. Prorotated amount would be deducated including any offers included  and remaining  would be refunded within 15 working days.

CANCELLATION POLICY

While we offer value for money paid to us, and strive for best client services, however  for reasons unknown, if a paid user can seek cancellation of their services within 30 days of contract end day.  Services would be terminated basis the available duration.

CONTESTS AND REWARDS PROGRAM

Rewards program are launched  with the intent to motivate responsible and safe driving. Points are generated basis the trip quality. Users can redeem the accumulated points for listed brand voucher with not additional fee. Drivecarma and its employees cannot participate in challenges or contests launched by the company. Due to early stage, we trust our Customers and expect the users to start or end a trip while they drive their vehicle, any misrepresentation would lead to termination of service. If trips are captured due to an error, feel free to use the delete  trip option.

JURISDICTION

Any dispute arising to be notified via email, we would address in best possible way. Legal jurisdiction would be Hyderabad, India

TERMINATION OF SERVICE & AVAILABILITY:-
User access to Mobile app may be terminated or suspended at any time, with notice and for any reason that deemed necessary by Drivecarma.While me make every possible attempt to ensure application availabilty, however cannot be guranteed on instances beyond our control where services could get disrupted either due to natural calamities, Server maintenance, or  tech downtime any other instance which impacts app performance. DriveCarma app has exclusive copyright to its product design, functionality, attempt by users to debug or repurpose product for other personal or commercial gains would be treated as breach of trust and suitable legal action.
